Types of Stay Permit for foreigners in Indonesia

In order to fulfill the legal requirements that apply in Indonesia, every individual foreign national residing in Indonesian territory is required to have a stay permit. This stay permit is an official document that provides legality of stay and is recognized by the authorities, ensuring that every foreigner’s presence in Indonesia is in accordance with applicable regulations and can be legally accounted for.

The immigration stay permit that can be held by foreigners in Indonesia includes various categories, which are tailored to the purpose of stay and the activities to be carried out. Some of the residence permits commonly granted by Indonesian immigration authorities include:

1. Visit Stay Permit (ITK)

Is a permit granted to foreigners to stay and be in the territory of Indonesia for a short period of time in the context of a visit.

Visit Stay Permit is granted to:

  1. Foreigners who enter Indonesian territory with a visit visa,
  2. A newborn child in Indonesian territory and at the time of birth the father and/or mother is a holder of a Visit Stay Permit.

The Visit Stay Permit granted to foreigners as mentioned above, may also be granted to:

  1. Foreigners from countries that are exempted from the obligation to have a visa in accordance with statutory provisions
  2. Foreigners serving as crew members of conveyances that are anchored or located in the territory of Indonesia in accordance with statutory provisions
  3. Foreigners who enter the territory of Indonesia in an emergency, and
  4. Foreigners who enter the territory of Indonesia with a Visit Visa upon arrival.

The Visit Stay Permit expires because the holder of the Visit Stay Permit:

  1. Returns to his/her home country;
  2. His/her permit has expired;
  3. His/her permit changes its status to a limited Stay Permit;
  4. His/her permit is canceled by the Minister or a designated Immigration Officer;
  5. Subject to deportation; or
  6. Passed away

2. Limited Stay Permit (ITAS)

Given to Foreigners who enter the Indonesian Territory with a limited stay Visa or Foreigners who are granted a change of status from a visit Stay Permit, which includes:

  1. Foreigners in the context of capital investment;
  2. Working as an expert;
  3. Performing duties as a clergy;
  4. Participating in education and training;
  5. Conducting scientific research;
  6. Merging with the husband or wife of a limited Stay Permit holder;
  7. Merging with the father and/or mother of a foreign national child who has a familial legal relationship with an Indonesian citizen father and/or mother;
  8. Merging with the father and/or mother of the holder of a limited Stay Permit or Permanent Stay Permit for children under 18 (eighteen) years old and unmarried;
  9. Foreigners who are former Indonesian citizens; and
  10. Foreign elderly travelers.
  11. Children who at the time of birth in the Indonesian Territory whose father and/or mother hold a limited Stay Permit;
  12. Ship’s captain, crew, or foreign experts on board ships, floating devices, or installations operating in Indonesian waters and jurisdiction in accordance with the provisions of laws and regulations;
  13. Foreigners who are legally married to Indonesian citizens; or
  14. Children of Foreigners who are legally married to Indonesian citizens.
  15. A limited Stay Permit may also be granted to a Foreigner to perform brief work.

The limited Stay Permit ends because the holder of the limited Stay Permit:

  1. Returns to his/her home country and does not intend to re-enter the Indonesian Territory;
  2. Returns to his/her home country and does not return again beyond the validity period of his/her Re-Entry Permit;
  3. Acquires the citizenship of the Republic of Indonesia;
  4. His/her permit has expired;
  5. His/her permit has changed its status to Permanent Residence Permit;
  6. His/her permit is canceled by the Minister or a designated Immigration Officer;
  7. Subject to Deportation; or
  8. Passed away.

3. Permanent Stay Permit (ITAP)

Is a permit granted to certain foreigners to reside and settle in Indonesian territory as Indonesian residents.

Permanent Residence Permit can be granted to:

  1. Foreigners holding a limited Stay Permit as clergy, workers, investors, and the elderly; family due to mixed marriage;
  2. Husband, wife, and/or children of a Foreigner holding a Permanent Residence Permit;
  3. Foreigners who are former Indonesian citizens and former subjects of children with dual nationality of the Republic of Indonesia
